Fair Housing: More Than a Principle, It's the Law.

Laws That Protect You

Federal and state fair housing laws ensure a fair and equal playing field for all homebuyers during real estate transactions. These laws prohibit discrimination based on race, color, religion, sex (including gender identity and sexual orientation), disability, familial status, and national origin.

Civil Rights Act of 1866

  • Prohibits discrimination in housing based on race or color.
  • Allows private rights of action but lacks federal enforcement provisions.

Civil Rights Acts of 1968 and 1988 Amendments

  • Expands protections to include race, national origin, color, and religion.
  • 1988 amendments further include age, sex, and disability.

Fair Housing Act

  • Combines the Fair Housing Act of 1988 and Title VIII of the Civil Rights Act of 1968.
  • Establishes a national policy prohibiting discrimination in housing based on race, color, religion, sex, disability, familial status, or national origin.

Americans with Disabilities Act

  • Title III prohibits discrimination against individuals with disabilities in commercial facilities and public accommodations.

Equal Credit Opportunity Act

  • Prohibits credit application discrimination based on race, color, religion, national origin, sex, marital status, age, or public assistance income.

Know Your Rights and Responsibilities

Everyone involved in real estate transactions, including home sellers, buyers, agents, mortgage brokers, and loan officers, has rights and responsibilities under the law.

Sellers' Responsibilities

  • Sellers and landlords must not discriminate in the sale, rental, or financing of properties.
  • Prohibited from setting discriminatory terms in contracts or leases.
  • Must not deny housing availability or advertise availability selectively.

Real Estate Professionals' Responsibilities

  • Agents, mortgage brokers, and loan officers must adhere to anti-discrimination laws.
  • They cannot follow discriminatory instructions from sellers or landlords.

Reporting Violations

If you believe you've faced housing discrimination, you can file a complaint with the U.S. Department of Housing and Urban Development (HUD) by calling (202) 708-1112 (Voice) or (202) 708-1455 (TTY). Visit HUD online at HUD's website.
